Fignny Co., Ltd. (hereinafter refer to as "Fignny") defines personal information as information on living individuals described in the Personal Information Protection Act (Name, Date of Birth and other information that can identify specific individuals), as well as email addresses, user IDs, passwords, credit cards, hobbies integrated with individuals, family structure, age and other personal attribute information.

In handling personal information, Fignny will specify, as clearly as possible, the purpose of its use.

Regarding cookie, advertising identifiers (including Identifier for Advertisers/IDFA and Google Advertising Identifier/AAID, but not limited to these) and IP address information (collectively referred to as 'cookies and the like'), although they cannot individually identify specific individuals, when these pieces of information are used in conjunction with personal information, they will be treated as personal information. When using cookies and the like on media operated by Figany, even if it is not possible to identify specific individuals, we will disclose the purpose and methods of their use. Additionally, it is possible to reject cookies and advertising identifiers through browser and OS settings. In the event that services cannot be received due to such refusal settings, we will also make an announcement to that effect.

Without individuals prior consent, Fignny will not handle personal information beyond the scope required to achieve its intended use. Even in the case of mergers, acquisitions, etc., they will not be handled beyond the scope of the prior use. However, it is not included in the following cases:

• In the case of laws and regulations
• Cases where it is necessary for the protection of human life, body or property and it is difficult to obtain the consent of the individual
• Where it is particularly necessary for public health, the purpose of promoting the development of children's health or when it is difficult to obtain the individual's consent
• In cases where it is necessary for a national organization or a local public entity or a person commissioned to carry out the office work prescribed by the law

Fignny will not acquire personal information by false or other fraudulant means. We also try not to collect personal information from children under the age of 15 without parental consent.

Fignny will announce the purpose of obtaining personal information in advance. However, this is not the case in the following:

• In case where notifying the person of the purpose of use or making a public announcement is likely to harm the life, body, property or other rights of individual or any third party
• Cases where notifying the individual of the purpose of use will bring risk of harming Fignny's rights or legitmate benefits
• Where it is necessary to cooperate with a national organization or a local public entity in order to carry out the office work or notifying the individual of the purpose of use may hinder the performance of the affairs
• Where it is recognized that the purpose of use is clear from circumstances of the acquisition

When changing the purpose of using personal information, Fignny shall not go beyond the scope considered reasonably relevant to the purpose of use prior to the change and shall notify or announce that the purpose of use has changed.

Fignny establishes personal information protection rules and conducts necessary and appropriate supervision of its employees to ensure the prevention of personal information leakage, loss or damage and other security controls.

When outsoursing the handling of personal information in whole or in part, Fignny will seek agreement on contracts with its consignee, including confidentiality, or on terms and conditions established by Fignny and will conduct necessary and appropriate supervision of personal information.

Fignny will not provide personal information to third parties without individual's prior consent, except in the following cases:

• Cases under laws and regulations
• Cases where it is necessary for the protection of human life, body or property and it is difficult to obtain the consent of the individual
• Where it is particularly necessary for public health, the purpose of promoting the development of children's health or when it is difficult to obtain the individual's consent
• Where it is necessary to cooperate with a national organization or a local public entity in order to carry out the office work or notifying the individual of the purpose of use may hinder the performance of the affairs
• When the following matters are notified or announced in advance:
  • Include provision to third parties for the purpose of use
  • Data to be provided to third parties
  • Means or methods of provision to third parties
  • Cease providing personal information to third parties upon request of the individual
      However, the following cases do not apply to third parties specified above:
  • In the case where Fignny entrusts all or part of the handling of personal information within the scope necessary for the achievement of the purpose of use
  • Cases where personal information is provided as a result of the succession of businesses due to mergers or other reasons
  • In case of sharing or using items of personal information with a particular individual jointly, the scope of the individual to be utilized jointly, the purpose of use of the individual and the management of personal information

Fignny will place the following matters concerning personal information in a state known to the individual and responds promptly to the request without delay

• Purpose of use of personal information (However, the law of the protection of personal information act excludes those that are not obligated. If you make a decision not to respond, you will be notified to that effect without delay.)
• Contact information regarding personal information

When Fignny is requested by individual to disclose personal information, it will be disclosed without delay. However, disclosure will not apply to the following cases:

• In cases where it is likely to harm the life, body, property or other rights of individual or any third party
• Cases where it is likely to cause serious harm to the proper performance of Fignny's business and work
• Cases where it is in violation of other laws and regulations

If an individual requested to correct, add or delete the content (hereinafter referred to as "correction, etc.") due to a lack of truth in the personal information, Fignny shall conduct necessary investigations without delay in accordance with the provisions of other laws and regulations. To the extent necessary for the achievement of the purpose of use, personal information shall be corrected, etc., based on the results and the individual shall be notified.

Fignny shall be suspended from using personal information of an individual based on the reason that these information being handled by Fignny beyond the scope of the purpose of use published in advance, or falsly obtained by other wrongful means or fraud. If deletion is required (hereinafter referred as "suspention of use, etc.") a necessary investigations will be conducted without delay. Based on the results, suspension of use of personal information will be notified to the individual. However, in cases where there is a large amount of cost for the suspension of the use of personal information, or where it is difficult to suspend the use of personal information and where it is possible to take an alternative measure to protect the rights and interests of the individual.

Fignny, despite individual's request,

• Not to notify the purpose of use
• Not to disclose all or part of personal information
• Not to suspend the use of personal information
• Not to suspend providing personal information to third parties

when deciding on any of the above, we will try to explain the reason when notifying the individual to that effect.
